CADE and OECD Close the Activities of the Latin American and Caribbean Competition Forum

The OECD Latin American and Caribbean Competition Forum was held from September 27 to 29 in Rio de Janeiro. On the final day of the Forum, OECD Regional Centre for Competition meeting discussed initiatives and actions in the digital market.

The meeting was divided into two parts. In the first panel, there was a debate about regulatory initiatives in the digital sector and in the second, enforcement and advocacy actions in digital markets were discussed.

Rodrigo Luchinsky, representative of the Argentine competition authority, presented details of one of the most significant cases from that jurisdiction regarding enforcement in digital markets, which was the Whatsapp case. He recalled that in 2001, when the company intended to update its terms and privacy policy, the National Commission for the Defense of Competition (CNDC) initiated an investigation for alleged abuse of dominant position.

Diogo Thomson, CADE's deputy superintendent, pointed out that the agency has adopted a more cautious policy on the regulation of digital platforms. He recalled that CADE has already judged at least 15 cases of anticompetitive conduct involving digital markets and pointed out that dozens more are under analysis. In these cases, the relationship between traditional markets and digital markets presents itself as one of the immediate difficulties.

The event was closed by Brenda Hernández, representative of the Federal Commission of Economic Competition, from Mexico, who recalled the importance of strengthening the discussions of the agendas brought at the meeting. For her, sharing the experiences of each body helps in the advancement of antitrust policies in all countries, because often the difficulties faced are similar.
