The Digital Child and Adolescent Statute (ECA Digital) could become a foundation for regulating artificial intelligence, said ANPD advisor. The statute comes into force in March.
The Digital Child and Adolescent Statute (ECA Digital) could serve as an important reference for regulating artificial intelligence, according to Lucas Borges, advisor to the board of the Brazilian Data Protection Authority (ANPD).
In September, the Brazilian government passed Bill 2628/22, known as ECA Digital, which establishes a series of responsibilities for tech companies to protect minors and prevent crimes against them in digital environments.
“ECA Digital can be applied and offer strong parameters for the use of AI and for protecting children and adolescents in relation to AI,”
Borges said at the Data Privacy Global Conference.
He noted that while there are studies on social networks, research on generative AI and its impact on younger users remains scarce.
According to Borges, several principles embedded in ECA Digital could be adapted for AI governance, including parental supervision, age verification, design standards, and restrictions on inappropriate content.
“These parameters are highly relevant and can serve as safeguards and limits on the use of AI by children and teenagers,”
he added.
According to Borges, this is an area where much of ECA Digital’s application could occur in the future. The statute comes into force in March.
